Misleading and abuse of false short stay rental contract This real estate agent misled me as a tenant with an illegal 'short stay' rental agreement. By doing so, the agent is exploiting a fake 'short stay' contract name to circumvent the new law on fixed-term tenancy agreements starting July 1, 2024 (this has been happening massively since the introduction of the law and this real estate agent apparently collaborates with the landlord in this practice. This is very inappropriate behavior. Real estate agents must be aware of current rental laws because these are complex and frequently changing. Knowledge of them is crucial to comply with applicable legal regulations and prevent problems. By doing this, the agent has breached their duty of care towards me as a tenant. After filing a complaint about it, they suddenly want to terminate my contract in one month (!) without valid reason. This is obviously invalid. A notice must meet legal requirements, but apparently, this real estate agent does not even know that (or this is their practice). They clearly lack knowledge and are not up-to-date with current laws. Furthermore, they show little regard for the rights or interests of tenants. Instead of professionally addressing the issue according to the new law and recent judicial decisions (by the Supreme Court on the abuse of false 'short stay' contracts), they choose to take my complaint seriously as a result leading to an expensive lawyer and court case. I thought I would be protected because it was through an 'NVM real estate agent,' but now it turns out this is not the case. I am compelled to report these inappropriate practices to the disciplinary committee of the NVM. This simply cannot stand. The courts are clearly on record, but apparently, this real estate agent does not care about that either. NVM real estate agents should adhere to the NVM Code of Honor, however, in my case, it has been completely violated: - expertise is nowhere to be found with this real estate agent and they clearly take sides for the landlord - this misleading situation is far from fair or respectful towards me as a tenant - clarity and transparency are lacking in my case; they did not keep their promises and were/are not honest - their email about terminating my contract does nothing to improve the situation or facilitate communication - they do not take complaints seriously and do not seek solutions It is extremely worrying that this so-called NVM real estate agent behaves so improperly. This was my first time renting a property, the housing market is already a huge mess with absurd rental prices, and now I have also encountered this on top of it (I did not ask for this, but found out by chance). It has also become clear that I am overpaying monthly and have already paid €2300,- too much! It's an enormous mess. This real estate agent does not think at all about how this must be for me as a tenant and focuses entirely on saving themselves and the landlord from this situation. Their first reaction is to get rid of the deceived tenant. I am very disappointed and angry, their actions speak for themselves.
