Please pay attention to the defects when buying a house with this real estate agent. We recently bought a house that was for sale through Westhuis Makelaardij. During our first visit, we asked if there were any (technical) defects in the house, and we were told by realtor Kirsten that, to her knowledge, there were no current defects. During the final inspection, it turned out that there were indeed defects, namely a defect in the shutters which the seller admitted and had also indicated to their real estate agent at the time. Realtor Kirsten stated that she did not mention this (whether knowingly or unknowingly). This was subsequently documented in writing in the final report, as well as that the defect would be resolved by the sellers, together with the realtor. However, the repair work on the shutters has unfortunately not been carried out. After repeatedly attempting to contact realtor Kirsten by telephone and in writing, we ultimately gave her notice of default. In response to this, realtor Kirsten insisted on not pursuing the matter further, arguing that we were already aware of the defect during the final inspection, which is incorrect and incomplete. During the building inspection, it was not noted that the shutters were defective, only that they did not work at that specific moment. The substitute real estate agent present at the building survey indicated that she could also find nothing about this in the file. In the realtor’s defense after the final inspection, she informed us that the substitute real estate agent had indicated this during the inspection. An inaccuracy. Fortunately, we are well insured and the damage was covered by our insurer. They stated that we would have won the case, but the legal costs would be higher than the damages incurred. Due to the above events, we unfortunately experienced more stress than necessary at the time of a relocation. It’s a shame that such real estate agents still exist. In light of the above, this may be a reason why Westhuis Makelaardij is not affiliated with NVM.
