Absolutely incorrect in business matters. Withholds essential information from buyers, preventing you from being properly informed. Also provides inaccurate information on the website and Funda. Everything is geared towards sales but not towards providing correct and proper information to the buyer. It's fine that you respond to the above review, but it would demonstrate professionalism if you depicted a correct course of events in your response. It is true that I did not have personal contact with you. I sent you a registered letter on 6-8-2020 regarding the business sheds offered by you at Capucijnenstraat 195 in Tilburg. I am the owner of the adjacent building at number 193 and almost half of the passageway between two homes is my property. No right of way has been established for the section that belongs to 195. You never had the decency to respond to this letter, unlike the NVM real estate agent whose client purchased the property, who responded within 1 day after receiving the letter and subsequently updated the website on Funda with correct information. That forced me to put up a notice on my property for interested buyers about the inaccuracy of your information. You state on the website and on Funda that the plot offers opportunities for project development; that is not the case at all. The entire plot and the business halls are subject to a residential designation, but because there is no building area designated in the zoning plan, a home cannot simply be built and the zoning plan must first be amended. The previous owner initially tried to turn it into apartments but did not receive an environmental permit for this purpose. Afterwards, he tried to make garage boxes of it to rent and sell them. For that, the municipality initially granted an environmental permit which they had to revoke after an objection from me because the owner was unable to demonstrate that he had a right of way over my section of the aforementioned passageway. Your client purchased the plot and halls in mid-2020 for €110,000 because she assumed she could build homes by making a purchase and through land swaps, but she miscalculated that and therefore it is now for sale with you shortly after purchase. So far, more than 10 people have approached me because they were interested. They all received the information from me as well as the rejection of the environmental permit from the municipality of Tilburg stating that a right of way could not be demonstrated. All those involved dropped out except one party who did make an offer but later withdrew it after a conversation with me. From everyone I spoke to in this matter, I heard that you describe me in your sales conversations as a difficult loon to be ignored. Moreover, I have a file from the past 30 years which clearly shows how often criminal and environmental offenses have taken place in the building. After finding an XTC laboratory, the property was closed by the municipality for a year and has been vacant ever since. Your client was informed prior to the purchase that there was no right of way applicable but nevertheless proceeded with the purchase. In the past, I, together with a specialized lawyer, the Cadastre and legal assistance insurance, investigated everything thoroughly. Based on their conclusions and advice, I subsequently acted. You may have consulted a notary or lawyer, but if you do not have the complete file, you cannot receive correct advice either. It would have demonstrated professionalism if you had contacted me after receiving my letter and entered into discussions; you consciously chose not to do so.
