GEDAGVAARD VOOR DE RECHTBANK NA SLECHT CONTRACT. Via Boumij Makelaars woning in de Ackersdijckstraat uit jaren dertig verkocht gesitueerd in de populaire vooroorlogse wijk de Vliert in Den Bosch . De woning beschikte over nog al wat achterstallig onderhoud daarom in overleg met de Boumij besloten het pand te koop aan te bieden als een pand voor ALGEHELE renovatie , tevens 100.000 euro onder de gangbare verkoopwaarde. Als vertegenwoordiger van Boumij Makelaars trad op de heer Eric van Houtum , welke de zaak verder in begeleiding heeft genomen en afgehandeld zoals hieronder omschreven. Het koopcontract is aldus geheel en al opgemaakt door de Boumij zonder enige inmenging of bemoeienis op welke wijze dan ook mijnerzijds. Boumij Makelaars heeft echter verzuimd vorenstaande situatie in het koopcontract te omschrijven of daar melding van te maken. Ik werd hierop door koper gedagvaard voor het WILLENS EN WETENS niet vermelden van verborgen gebreken. Opgevoerde vordering in de dagvaarding bijna 9000 euro Voorafgaande aan de rechtszitting heb ik uiteraard de makelaar , de heer Eric van Houtum geraadpleegd hoe dit correct af te handelen. Het advies : maak je niet druk een advocaat is niet nodig , de koper/eiser heeft geen poot om op te staan. Vorenstaande casus is inmiddels voor de rechter geweest. De rechter oordeelde hier totaal anders over en liet tijdens de zitting heel duidelijk doorschemeren : meldplicht verkoper prevaleert boven onderzoeksplicht koper. Tijdens de zitting met de eiser een schikking overeengekomen , daar bij een voortgang in dit traject de kosten voor mij nog veel verder konden gaan oplopen. Achteraf uiteraard contact opgenomen met de makelaar de heer van Houtum met de vraagstelling : Wie gaat de aantoonbaar door jullie veroorzaakte schade aan mij vergoeden ? Het antwoord van de heer van Houtum: eigen schuld , had je maar niet moeten schikken, zowel van Houtum als Boumij Makelaars geven verder geen enkele inhoudelijke reactie meer en reageren helemaal nergens meer op. IK BEHOOR MIJ NIET TE HOEVEN VERANTWOORDEN VOOR DE RECHTBANK NA VERKOOP VAN MIJN WONING. DE MAKELAAR BEHOORT IMMERS OP DE HOOGTE TE ZIJN VAN ALLE RECHTEN EN PLICHTEN EN TEN ALLE TIJDE EEN GERECHTELIJKE PROCEDURE TE VOORKOMEN, OF MIJ TIJDENS EEN DERGELIJKE DOOR MIJ ONGEWENSTE EN NIET VEROORZAAKTE PROCEDURE TE BEGELEIDEN OF OP ZN ALLERMINST VAN FATSOENLIJK (JURIDISCH) ADVIES TE VOORZIEN !
