However, Boumij Makelaars failed to describe the aforementioned situation in the purchase contract or make any mention of it. I was therefore summoned by the buyer for the WILLING AND KNOWING non-disclosure of hidden defects. The claimed amount in the summons was almost 9000 euro. Prior to the court hearing, I of course consulted the agent, Mr Eric van Houtum, on how to correctly handle this. The advice: don't worry, a lawyer is not needed, the buyer/claimant has no leg to stand on. The aforementioned case has since been before the court. The judge ruled completely differently and made it very clear during the hearing: seller's duty to disclose prevails over buyer's duty to investigate. During the hearing with the claimant, a settlement was reached, as further progress in this procedure could have caused my costs to increase even more.
